MARINA DOCKING LEASE
This lease, effective for the summer season which is approximately May 1, 2006, to October 31, 2006, weather and conditions permitting, is between Burkehaven BoatWorks, LLC, of 232 Burkehaven Hill Road, Sunapee, New Hampshire, referred to as MARINA, and _________________________ of __________________________________________ referred to as BOAT OWNER.
MARINA leases to BOAT OWNER and BOAT OWNER takes by hire from MARINA, that portion of MARINA’s piers known to MARINA as a dock space designed for a boat of less than 20 feet.

SECTION TWO
BOAT OWNER shall pay MARINA, for the use of the docking space, $ __________________ for the summer season. All checks should be made payable to: Burkehaven BoatWorks, LLC
SECTION THREE
MARINA reserves the right to alter or amend the terms and conditions of this lease from time to time by:
a. Written notice to BOAT OWNER; and
b. Prominent publication by notice on the MARINA grounds.
SECTION FOUR
BOAT OWNER covenants to exercise due care in occupation of the leased docking slip and to vacate the slip in good condition, only wear and tear occasioned by normal use excepted. This lease is for rental of docking space only, such space is to be used at the sole risk of the owner of the vessel, and the MARINA shall not be liable or responsible for the care of protection of the boat (including gear, equipment, and contents) nor for any loss or damage of whatever kind or nature to the boat, its contents, gear, or equipment, howsoever occasioned. BOAT OWNER shall indemnify and hold harmless MARINA from and against all claims, actions, proceedings, damages, and liabilities, including attorney fees, arising from or connected with BOAT OWNER’s possession and use of the leased docking space.
SECTION FIVE
BOAT OWNER agrees to keep his/her boat adequately insured with hull and liability insurance.
SECTION SIX
BOAT OWNER acknowledges that he/she has inspected the leased docking space and is satisfied that the docking space is adequate for safe mooring of the vessel. This contract is not a bailment of the BOAT OWNER’s boat but a lease of docking space, and MARINA’s liability is limited to supervision and maintenance of waterfront area. MARINA’s employees will make reasonable efforts to contact BOAT OWNER and notify him/her of dangerous conditions requiring BOAT OWNER’s attention but MARINA assumes no responsibility for tending mooring lines or moving boats from the docks to which they are assigned.
SECTION SEVEN
DEPOSIT
A non-refundable fifty percent (50%) deposit of all fees, due by January 1, 2006, will hold the docking space. Payment is due in full by May 1, 2006.
SECTION EIGHT
ASSIGNMENT AND SUBLETTING
BOAT OWNER shall not assign or sublet the leased docking space without the knowledge and approval of MARINA even if the boat has been sold. A MARINA DOCKING LEASE must be filed for all boats using these facilities.
